1. Agreement and Acceptance

Welcome to Essential Handpiece Repairs ("Company," "we," "us," or "our"), operated from Colorado Springs, Colorado. These Terms and Conditions ("Terms") govern your access to and use of our website www.essentialhandpiecerepairs.com (the "Site"), all services, repairs, sales, and interactions with us.

By accessing the Site, submitting a repair, placing an order, or using our services, you agree to be bound by these Terms. If you do not agree, do not use our Site or services.

These Terms contain important limitations on our liability, warranty disclaimers, and dispute resolution provisions. Please read them carefully.

2. Services Overview

We provide dental handpiece repair services (high-speed, low-speed, electric, scalers, and attachments), sales of new/refurbished handpieces and parts, and related support. All services are subject to these Terms, our Privacy Policy, and any specific agreements.

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account and password and for all activities under your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4. Electronic Communications

By using our Site or communicating with us via email, phone, or text, you consent to receive electronic communications. These satisfy any legal requirement for written communications.

5. Repair Process, Estimates, and Payment

• We perform a thorough inspection upon receipt. A detailed repair estimate is provided before any work beyond initial evaluation.
• Estimates are valid for 30 days.
• If no response is received within 30 business days, we will return the item(s) at your expense (shipping + handling fee).
• Payment in full is required before repaired items are shipped back.
• Rush service may be available for an additional fee.
• We reserve the right to refuse repairs that are uneconomical or unsafe.

6. Shipping, Risk of Loss, and Packaging

Risk of loss during outbound shipping transfers to you upon our delivery to the carrier. We use reasonable care in packaging but are not liable for damage during transit.

7. Warranties and Disclaimers

Limited Warranty

Scope of Coverage. Our warranty covers only the specific parts we replaced during your repair, together with the labor to install them. It does not extend to components we did not replace — including the handpiece housing or shell, original bearings, turbines, or other parts left in service — even if those components fail after our repair. Coverage periods below apply to replaced parts and associated labor.

• High-speed turbines: 6 months parts and labor (one replacement) or 12 months with paid extension (unlimited replacements during period).
• Low-speed, electric, and attachments: 6 months parts and labor.

Warranty is void if: handpiece was not maintained per manufacturer guidelines, misuse/abuse occurred, or failure is due to parts other than those we replaced.

No-Fault Found Diagnostic Fee. Warranty coverage applies to defects in parts or workmanship from a repair we performed. If a handpiece is returned under warranty and our inspection finds no defect attributable to our work — including handpieces that test within specification, or whose condition results from normal wear, lubrication or sterilization practices, impact damage, or use of incompatible components — a diagnostic fee of $29.00 per handpiece may be charged at our discretion. We will notify you before applying any such fee, and return shipping will be arranged as normal.

Critical Medical Device Disclaimer

YOU ARE SOLELY RESPONSIBLE FOR VERIFYING THAT ANY REPAIRED OR PURCHASED HANDPIECE IS FULLY FUNCTIONAL AND SAFE BEFORE USE ON ANY PATIENT.

We make NO REPRESENTATIONS OR WARRANTIES that repaired handpieces (whether using OEM or compatible parts) meet OEM specifications, international standards, or are suitable for clinical use. It is your responsibility to test, sterilize, and confirm proper function before patient use.

ALL SERVICES AND PRODUCTS ARE PROVIDED "AS IS" WITH NO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC REPAIR OR PRODUCT AT ISSUE. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, OR SPECIAL DAMAGES, INCLUDING LOSS OF PROFITS, PATIENT CLAIMS, OR BUSINESS INTERRUPTION.

9. Uncollected Property and Artisan's Lien

We maintain a possessory lien on all items in our possession under Colorado law. If payment is not made, we may sell the item after providing required notices. You are responsible for storage fees after 60 days.

10. Intellectual Property

All content on the Site is our property or licensed to us. You receive a limited, revocable license for personal use only. You may not copy, modify, or commercially exploit our content.

11. Prohibited Uses

You agree not to use the Site or services for any unlawful purpose, to interfere with operations, or to infringe rights.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including attorney fees) arising from your use of services, violation of these Terms, or misuse of repaired equipment.

13. Dispute Resolution

Any disputes shall be resolved by binding arbitration in Colorado under the American Arbitration Association rules. Class actions are waived. Governing law is Colorado. You consent to jurisdiction in Colorado courts if arbitration is unavailable.

14. Termination and Changes

We may terminate access or services at any time. We may update these Terms; continued use constitutes acceptance.

15. Miscellaneous

These Terms constitute the entire agreement. If any provision is invalid, the remainder remains in effect. No waiver of rights. English language controls.
